1. Legal relationships
TUI AG provides an online booking functionality for end consumers on
this website. This is where the customer can check and directly book
accommodation features, services and options. These general terms and
conditions govern all use of these services.
An accommodation agreement between the respective hotel/provider and
the customer comes in to being when a booking is made over this website
for accommodation.
TUI AG acts only as agent for the accommodation provided.
In addition to these general terms and conditions governing TUI AG’s
activities as agent the general terms and conditions of the respective
selected hotel also apply for each booking.
2. Agency costs
The agency service provided via this website linking the customer with
accommodation providers is free of charge to the customer.
3. No extra services
When booking accommodation over this website this does not include
transfer to hotel nor customer care and attention by the local travel
representatives at the destination or the travel to the destination.
Moreover, the additional services and benefits that usually come with
the use of the TUI Card Classic or the TUI Card Gold are not applicable
when booking hotels through this website.
4. Guaranteed/non-guaranteed booking
The detailed provisions governing the cancellation of bookings
(guaranteed/non-guaranteed booking) are included in the general terms
and conditions of the respective hotel.
5. Confirmation of reservation
Room reservation is already included in the booking – without any
separate confirmation of the reservation. The customer can print out
the reservation during the booking procedure. In parallel the customer
is also sent an email confirmation. TUI AG cannot guarantee the
technically flawless receipt of the email confirmation. Non-receipt of
email confirmation does not affect the validity of the booking.
6. Improper use of the online booking tool
TUI AG endeavours to prevent improper use of the free reservation
system and to protect the hotels/accommodation providers from
unnecessary erroneous booking. We therefore reserve the right to
refuse or cancel bookings on a case basis if there are grounds for
reasonable suspicion of such improper use, e.g. if in the past the
credit card given could not be charged or if there are reasons for
suspecting that bookings are not being made for an end customer but for
speculative purposes.
7. Payment
As a rule the room price confirmed in the hotel booking system is
payable upon arrival at the hotel to the hotel/provider. In individual
cases a deposit may be charged to a customer’s credit card; for details
refer to the description of the hotel/accommodation in question.
8. Changes and cancellation
To make sure they are properly carried out all changes or cancellations should be made using the website booking system.
9. Hotel categories and information
The conventional international hotel classification system based on
stars provides a non-binding indication of the standard of the hotel.
The hotel classification is based on the self-appraisal by the
hotel/provider. Additional hotel information and description in the
booking system are based on information provided by the hotel.
TUI AG does not accept any liability for the correctness and validity
of the information – except in the case of gross negligence or wilful
intent on the part of TUI AG with respect to the correctness of the
details made.
The scope of the accommodation provided on the website is to some
extent fed in directly from international computer reservation systems.
These descriptions often include provisions written in the English
language that may have an influence over the scope of the
accommodation. The customer hereby accepts the full contractual
implications of these details written in English with respect to the
relationship to the respective hotel/provider.
10. Prices
The most favourable prices, depending on arrival and departure dates,
in the system are shown for the listed hotels. The binding quotation
for the hotel selected in the booking includes the applicable room
price in euros or in the respective local currency. The rates for the
rooms quoted are binding and are guaranteed for each reservation made.
Payment is made at the hotel in the local currency. The valid
price is the price shown in the local currency.
All prices are per room and per night and may or may not include board
in line with the information provided by the hotel. Service charges and
statutory value added tax are usually included and under certain
circumstance additional taxes or duties may be added to the room price.
Such surcharges are made in line with country-specific regulations and
statutes. Because constant changes cannot be ruled out all details
governing the amount of tax are non-binding and serve orientation
purposes. Details of all surcharges on the room price are provided in
the description of the respective hotel/accommodation.
11. Assertion of rights, duties of the customer
All rights and duties stemming from the accommodation agreement are
exclusively between the customer and selected hotel/provider.
Any defects in agency services provided by TUI AG must be reported to
TUI AG without delay, and TUI AG must be provided with the opportunity
of rectifying and remedying the defect. If no report is
made for culpable reasons, all claims by the customer for damages
stemming from the agency agreement are invalidated inasmuch as TUI AG
would have been able to provide reasonable remedy.
It is up to the customer to seek information before commencement of
travel and depending on destination on applicable passport, visa,
customs, foreign exchange, pet and health laws and regulations.
12. Liability of TUI AG
TUI AG is not liable for the success of its activities as agent or for
delivering accommodation services and components. TUI AG is only liable
for ensuring that the agency services are performed with the due care
and diligence of a prudent businessman. Moreover no warranty is given
for the correctness, completeness and reliability of third party
content in the booking system, especially with respect to facts on the
individual hotels except in the case of TUI AG possessing information
or not possessing such information for reasons of gross negligence
regarding the incorrectness of certain facts. The administration and
updating of the hotel information is the responsibility of
hotel/provider listed in the booking system. Moreover the general terms
and conditions as well as other regulations of the respective
hotel/provider are applicable when concluding a contract.
TUI AG endeavours to its best ability to ensure that the information
and other date posted on the website are current, complete and correct
at the time of publication.
TUI AG cannot however guarantee the correctness, completeness or
reliability of such information and data, as their administration and
updating is the responsibility of the respective hotel/provider.
13. Act of God
In the framework of this contract TUI AG is not liable for the
consequences of acts of God. These include orders issued by
authorities, war, civil unrest, aircraft hijacking, terrorist attacks,
fire, electrical power cuts, accidents, natural disasters, strikes,
lockouts and other labour dispute actions which impact on the services
provided by TUI AG or its contractual partners.
14. Changes to the general terms and conditions
TUI AG reserves the right to change or renew the general terms and
conditions for using this website at any time in the future without in
any way implying any duty to notify the customer thereof. The currently
applicable and valid general terms and conditions are posted on the
website. By continuing to use the website for new bookings after a
change in the general terms and conditions the customer declares
acceptance of such changes.
15. Separability clause
Should any of the provisions above be or become void, the validity of
the remaining provisions hereof shall in no way be affected. In such
case the void provision shall be replaced by relative provision coming
as close as possible to the sense and spirit and purpose of the
provision to be replaced.
Data protection declaration
TUI AG regards the protection of the private sphere and personal data
as being of the greatest importance. We therefore concentrate
considerable attention on this issue when implementing our internet
activities. Our data protection practices are in full conformity with
applicable and valid data protection statutes and regulations. To
best protect your data against accidental or intentional manipulation,
loss, destruction or access by unauthorised persons we have implemented
technical and organisational security measures. We continually optimise
our security measures in line with technical advances.
Personal data
Personal data are items of information that can be used to establish
your identity. These include information related to your name, street
address, postal address and telephone number.
We only gather, process and use your personal data if you voluntarily
furnish us with these data for purposes of carrying out a hotel booking
or of using special services, such as subscribing to a newsletter.
For purposes of delivering the accommodation services and components we
furnish the respective contractual partner with your personal data.
The use and processing of your personal data for advertising purposes
is only carried out if you have given your consent. Your consent is
voluntary and can be revoked at any time by notifying TUI AG
(iberotel.headoffice@tui.com; info@fastbooking.com ).
If data are forwarded to TUI AG’s service providers they are also bound
in addition to the mandatory statutory regulations also to TUI AG’s
contractual requirements governing data protection. The transfer of
personal data to state agencies and authorities is only done in the
framework of mandatory legal requirements.
Anonymised data
General information (e.g. number and duration of visits to individual
pages on this site) is automatically stored whenever the contents of
this internet service are accessed. These data are not personal. They
are used exclusively for statistical purposes and optimising our
internet service provision.
Your rights
You are entitled if you so request and at no cost to be furnished with
information on data stored concerning you. Furthermore, you have the
right to correct, delete or block incorrect data. Under certain
circumstances deletion may be precluded by statutory provisions,
especially in the context of data required for accounting and
bookkeeping purposes.
